the scandal that's led to david petraeus resigning from the cia. that's certainly not the first sex scandal to bring down someone in washington, it certainly won't be the last. but tonight there are growing questions about the timing of how the word got out, whether more people in the government should have been told or been told sooner that the fbi was investigating a case involving the director of the cia. we're keeping them honest as we do every night not to take sides, you can get that on other cable news channels, but to look for the truth, the facts. here's what we know right now about who knew what and when. according to "wall street journal" the fbi discovered the affair between petraeus and his biographer, paula broadwell, in late summer. we'll have more on how in just a moment. so the fbi reportedly knew in late summer that the head of the cia was having an affair, but it wasn't until months later after election day that president obama found out, and the house and senate intelligence committees didn't find out until friday. congressional leaders from both parties are angry, they

, because you have a woman who has these harassing e-mails, a couple of which mention david petraeus, but they're not threatening to her, nor are they accusing anyone of having an affair. so she has these annoying e-mails but they mention things that are personal information about her that she finds disturbing so she goes to an fbi agent she knows and she says can i get this investigated. and that agent brings her into the tampa field office and the tampa field office has a cybersquad that does criminal work, and they look at it and say well, gee, there's no threat here and the agent says well, can we investigate this for this person. they open the statute book and look up the harassment part of the statute and say all right, we have a basis to open a case here. first let's find out who is on the other end of these e-mails. then over time, they're able to identify it's paula broadwell. then they figure out who paula broadwell is and at that point, the case, the aperture of the case starts to open because they say well, what's this e-mail account, what's this other e-mail account that

the republican house majority leader may have known about former cia director david petraeus' extramarital affair before the president did. that's according to aides to congressman eric cantor who tell us he found out from an fbi employee concerned that national security might have been breached as a result of the affair. cantor was told on october 27th. president obama didn't find out about the affair until after election day. congressional leaders from both parties are upset that neither they nor the president were informed until late last week. >> obviously this was a matter involving a potential compromise of security. and the president should have been told about it at the earliest date. >> reporter: a u.s. official said there was no breach of security as a result of the affair. a cantor aide says the congressman called the fbi's leadership to report the information he got on october 31st. but according to "the wall street journal," the fbi's probe had already been under way for months.
